General Terms and Conditions

1.    Scope

The General Terms and Conditions (hereinafter referred to as "GTCs") apply to all orders placed via the Flavors Boutique online shop (hereinafter referred to as "Flavors Boutique") and all contracts concluded (hereinafter referred to as "orders"). Flavors Boutique is operated by A&B Flavors GmbH.
The following GTCs create a legally binding agreement between you (or the “Customer”) and A&B Flavors GmbH ("we" or "us" as the context may require). By browsing, accessing and/or using any part of Flavors Boutique and/or using any of the services provided via Flavors Boutique and/or purchasing or attempting to purchase any product or service on Flavors Boutique, you shall be deemed to have read, understood and accepted these Terms as modified from time to time by us and thereby be legally bound by these Terms and modifications.
Flavors Boutique reserves the right to change the GTCs. The valid version of the GTCs at the time of placing the order shall apply. It may not be amended unilaterally for the relevant order. 

2.    Access and use of website

Flavors Boutique reserves all rights to deny or restrict access to this Website to any person, or to block access from any internet source or address to this Website at any time in its sole discretion, and without providing any notice or reason.

You may download, display or print the Contents (whether in whole or in part) solely for personal, non-commercial use, retaining and reproducing each and every copyright notice or other proprietary rights notice contained in any information or other material you download. Any other use including the reproduction, modification, distribution, transmission or broadcast of the Contents, in whole or in part and by any means, is strictly prohibited, except upon the prior written consent of Flavors Boutique.

Flavors Boutique neither warrants nor represents that your use of any of the Contents in this Website will not infringe the rights of third parties.
 

3.    Offers

Offers are made to customers who are either natural persons or legal entities domiciled in Switzerland. Deliveries may be made only to addresses in Switzerland.
Offers are valid for only as long as they appear on the online shop and/or while stocks last. Flavors Boutique may change its prices and product range at any time. The images used in advertising media, on the online shop, etc. as well as all information about the products themselves are for illustrative purposes only and are non-binding. Only the specific information displayed on the product packaging shall apply.

4.    Pricing

Prices are displayed in Swiss francs and include value-added tax (VAT).
The prices stated on the online shop at the time of placing an order shall apply.
Orders placed for additional products or services subject to charge, e.g. delivery, special packaging, are listed separately in the shopping cart and on the invoice.

5.    Ordering

The presentation of products on the online shop shall not constitute a legally binding proposal but rather a non-binding online catalogue or non-binding invitation to customers to order a given product on the online shop. Flavors Boutique reserves the right to limit the delivery quantities of specific products.
By placing an order through this Flavors Boutique, you have made an offer to purchase the products you have selected under these Terms.
All orders are subject to acceptance and availability, and items in your shopping bag are not reserved and may be purchased by other customers, if you do not immediately click the "Checkout" button.
Following placement of the order, the customer is automatically issued with a confirmation by Flavors Boutique, documenting receipt of the order. Customers may cancel their order only until order processing commences at our orders processing unit by sending their request by email to customer@flavors-noutique.ch.
Flavors Boutique may reject an order, either in its entirety or in part, without stating the grounds. In such cases, Flavors Boutique will inform its customers accordingly and refund any payments already made. No other claims shall be accepted. In particular, undeliverable products will not be delivered at a later date. Temporarily unavailable products cannot be pre-ordered.

6.    Conclusion of a contract

A contract shall be deemed to be concluded when the order is processed at a Flavors Boutique orders processing unite and the total amount have been paid. Customers will receive an order confirmation by e-mail as soon as the relevant order is ready for dispatch.
The data registered by Flavors Boutique constitutes full proof of the order and the entire transaction. The data registered by the payment system constitutes full proof of the financial transactions.

7.    Delivery

          a.    General
Delivery is processed by Swiss Post.


          b.    Region
The customer's delivery address must be in Switzerland.


          c.    Delivery period
Delivery is estimated to take place within 2-5 business days after the order is ready for shipment. Depending on the period of the year, the delivery may take longer than 2-5 business days. Time of delivery will follow Swiss Post usual timings. Flavors Boutique is not responsible for any delays, damage or loss that may occur from Swiss Post’s handling and/or processing of the customer’s delivery.
Deliveries cannot be made on Sundays or national or cantonal holidays.
If the customer is not present at the delivery address at the time of delivery, delivery will follow Swiss Post usual procedure. Depending on the package dimension the delivery will be left in the letterbox, at the front door of the apartment/house or the reception/entrance of the company.
Customers will be responsible for delivered products, even if they have not been received in person by the customer.


          d.    Delivery costs
The cost of delivery depends on the total value of the ordered products (minimum purchase value excluding delivery charges, deposits and credits). The cost of delivery stated on the online shop and delivery cost guidelines apply. Delivery costs are listed separately in the shopping cart and on the invoice.

8.    Warranty

Flavors Boutique guarantees the quality and shelf-life of its products under the following conditions:
Non-refrigerated food products and dry goods must be stored in their original packaging, unopened, in a cool, dry place away from sources of heat or light.
For customers who can provide evidence confirming compliance with these storage conditions, Flavors Boutique guarantees that ordered products will meet the relevant standards until the relevant best-before date, though for no longer than one (1) year from the date of delivery. A statutory period of one (1) year from the delivery date applies for products that do not bear a best-before date. In particular, the terms of the "money-back guarantee" described here shall apply.
Flavors Boutique can fulfil its guarantee through either partial or complete replacement by an equivalent product, a reduction in price or by issuing a credit note up to the sales price applicable at the time of the order.
Customers do not have a general right to return fault-free products that are delivered properly. Warranty claims are explicitly excluded for products whose intrinsic quality (for instance, their taste quality) does not meet the customer's expectations, which may be spoiled due to improper handling by the customer and for products ordered by mistake.
We have made every effort to display as accurately as possible the colours of our Products that appear in this Website. However, as electronic devices’ screens vary, we cannot guarantee that your screen’s display of any colour will be completely identical to our Products.

9.    Complaints and returns

THIS SECTION ON “Complaints and returns” DOES NOT AFFECT YOUR STATUTORY RIGHTS.
The customer is responsible to verify the quantity and condition of the purchases upon delivery.
Flavors Boutique controls all products before shipping. Should delivered products exhibit clear damage to their packaging or contents, the customer must immediately inform Flavors Boutique in writing within 24h from delivery. Any transport-related damage must also be reported to Flavors Boutique immediately within the following 24h.
It is also the customer’s duty to check ordered products immediately upon delivery and store them correctly. Opened or partially consumed products are excluded from any claims or returns. Any defects to or deviations from an order must be reported to Flavors Boutique of the day of delivery, by sending an e-mail to customer@flavors-boutique.ch. Thereafter, customers may only claim for hidden defects that must be reported to Flavors Boutique immediately upon discovery. The amount paid by customers for defective goods is credited to their account. Flavors Boutique reserves the right to request proof of defects.
Returns fees are on the customers charge.

10.    Payment

          a.    General
Payments must be made in Swiss francs.


          b.    Electronic payment
Customers may pay using credit cards (Visa, Mastercard, American Express) or Paypal/Twint. When paying by credit card or Paypal/Twint, the amount is charged after the order has been placed on the Flavors Boutique.
We take reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering through this Website.
We may also refuse to process and accept a transaction for any reason or refuse service to any person at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any Product from this Website whether or not that Product has been sold, or by removing, screening or editing any materials or content in this Website, or by refusing to process a transaction or unwinding or suspending any transaction after processing has begun.


          c.    Refunds and credits
If a customer is entitled to a refund or credit, the relevant amount is credited to the relevant customer’s account where it can be used for purchases at Flavors Boutique.

11.    Applicable law and jurisdiction

All legal relationships between Flavors Boutique and the customer are subject to the substantive law of Switzerland to the exclusion of conflict-of-law provisions and the United Nations Convention on Contracts for the International Sale of Goods (Vienna Sales Convention).
The place of jurisdiction is Zurich, Switzerland or the customer's domicile.
